Reise(n) mit PASSION! – Arrangement of Bible, study, church and group tours. Part A applies to all customers. Part B additionally applies to private travellers and individual bookers, Part C to groups (churches and congregations, associations, schools, organisations), Part D to travel agencies, agents and other resellers.
Part A – General Provisions
§ 1 Contracting Party and Role of Reise(n) mit PASSION!
(1) “Reise(n) mit PASSION!” is a brand of Besch Berufsbekleidung & Outdoor Reisen UG, Hauptstraße 44, 39164 Schleibnitz, Germany (hereinafter “PASSION”). E-mail: info@passion-reisen.de, telephone +49 39209 649448.
(2) PASSION acts as a contact office and travel intermediary. The tour operator and the customer’s contracting party for the travel services in Turkey is our incoming partner TATİLEGO TURİZM SEYAHAT İŞLETMELERİ SANAYİ VE TİCARET LTD. ŞTİ. (Condor Travel), İkiçeşmelik Mah. Süleyman Demirel Bul. Melis Apt. B Blok No: 21B İç Kapı No: 6, Kuşadası/Aydın, Turkey, member of TÜRSAB, Belge No. 14400 (hereinafter the “Tour Operator”). For travel to other countries, the respective tour operator will be named in writing prior to booking.
(3) PASSION acts in the name and on behalf of the Tour Operator and is authorised by the Tour Operator to collect payments. Payments made to PASSION shall be deemed payments to the Tour Operator.
(4) Where PASSION expressly offers a service as its own service (e.g. consultation, sales in the travel shop), PASSION itself is the contracting party.
§ 2 Statutory Obligations for Package Travel
(1) Where the travel constitutes a package within the meaning of §§ 651a et seq. BGB (German Civil Code), the customer shall receive the legally prescribed standard information form (Art. 250 § 2 EGBGB) prior to conclusion of the contract and, after conclusion of the contract, a travel confirmation and – where required by law – a security certificate (Sicherungsschein).
(2) The traveller’s statutory rights under §§ 651a to 651y BGB remain unaffected by these terms. No provision of these General Terms and Conditions may deviate from these statutory provisions to the detriment of the traveller; any such provision shall be deemed not to have been agreed.
§ 3 Prices, Flights and Services
(1) Unless expressly stated otherwise, all prices are exclusive of flights and exclusive of outbound and return travel to the destination country. The customer books flights themselves; upon request, PASSION will enquire about a suitable connection. A flight booked by the customer themselves does not form part of the travel contract.
(2) The scope of services is determined exclusively by the tour description, the individual offer and the travel confirmation. Collateral agreements must be made in text form.
(3) No sales events: Visits to carpet, jewellery, leather or similar sales establishments are expressly not part of our tours. They will only be organised separately at the express request of the group or of individual travellers.
(4) Pursuant to § 19 UStG (German VAT Act), no VAT is charged for PASSION’s services. For travel services abroad, the prices of the Tour Operator apply.
§ 4 Passport, Visa and Health Regulations
(1) Prior to conclusion of the contract, PASSION informs EU nationals of the general passport and visa requirements of the destination country and of health formalities. Nationals of other states may obtain information from the competent consulate.
(2) The traveller is personally responsible for carrying valid travel documents and for complying with entry and health regulations, unless PASSION or the Tour Operator failed to inform the traveller or informed the traveller incorrectly. Current information: German Federal Foreign Office (Auswärtiges Amt), www.auswaertiges-amt.de.
§ 5 Travel Insurance
Taking out travel cancellation and travel interruption insurance as well as international health insurance including repatriation is strongly recommended. These insurances are not included in the tour price.
§ 6 Duty to Cooperate and Notification of Defects
(1) The traveller must notify the local tour guide or the Tour Operator of any travel defect without undue delay and request remedy. If no tour guide can be reached, PASSION must be notified at +49 176 62157259 (also WhatsApp) or info@passion-reisen.de. If the traveller culpably fails to give notice, any claim to price reduction or damages may be excluded (§ 651o BGB).
(2) Damage to or delay of baggage on flights must be reported to the airline without undue delay by means of a property irregularity report (P.I.R.).
§ 7 Liability of the Intermediary
(1) As intermediary, PASSION is liable for the proper arrangement and forwarding of the booking, not for the performance of the arranged travel services themselves; the Tour Operator is liable for these in accordance with the statutory provisions. The statutory obligations of the travel intermediary, in particular under §§ 651v and 651y BGB, remain unaffected.
(2) For damage that is not bodily injury and was not culpably caused, PASSION’s liability is limited to three times the price of the arranged service, insofar as legally permissible. Liability for intent, gross negligence and for damage resulting from injury to life, body or health remains unaffected.
§ 8 Data Protection
Personal data are processed solely for the purpose of carrying out the tour and are passed on for this purpose to the Tour Operator and the service providers (e.g. hotels, transfer companies). Details are set out in our Privacy Policy.
§ 9 Consumer Dispute Resolution
PASSION is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
§ 10 Final Provisions
(1) German law applies. In relation to consumers, the mandatory consumer protection provisions of their state of residence additionally apply.
(2) For merchants, legal entities under public law and persons without a general place of jurisdiction in Germany, the place of jurisdiction is Magdeburg.
(3) These General Terms and Conditions are available in several languages. The German version shall prevail.
(4) Should any provision be invalid, the validity of the remaining provisions shall remain unaffected.
Part B – Private Travellers and Individual Bookers
§ 11 Enquiry and Conclusion of Contract
(1) The tour descriptions on the website are non-binding; prices are provided on request. In response to the customer’s enquiry, PASSION prepares an individual offer including the standard information form.
(2) By accepting the offer in text form (e-mail, letter, WhatsApp), the customer submits a binding offer. The contract is concluded upon receipt of the travel confirmation. The person making the booking is liable for the contractual obligations of all fellow travellers registered by them as for their own, provided they have expressly assumed this obligation.
(3) For package travel there is no right of withdrawal (§ 312g Abs. 2 Nr. 9 BGB); the cancellation rules in § 13 apply.
§ 12 Payment
(1) Upon receipt of the travel confirmation (and, where required, the security certificate), a deposit of 30 % of the tour price is due. The deposit is required because the Tour Operator must already bindingly reserve and make advance payments for hotels, transfers, tour guiding and admissions in the destination country at the time of booking. The balance is due 3 weeks (21 days) before the start of the tour. For bookings made less than 21 days before the start of the tour, the full tour price is due immediately.
(2) If the customer fails to pay despite a reminder setting a deadline, the contract may be cancelled and compensation may be claimed in accordance with § 13.
§ 13 Cancellation by the Traveller
(1) The traveller may cancel at any time before the start of the tour. Cancellation must be declared in text form to info@passion-reisen.de; the date of receipt is decisive.
(2) Instead of the tour price, reasonable compensation may be claimed. It amounts per person, based on the tour price, to:
- up to the 93rd day before the start of the tour: free of charge
- 92nd to 42nd day: 10 %
- 41st to 22nd day: 25 %
- 21st to 15th day: 40 %
- 14th to 1st day: 60 %
- on the day of departure and in the event of no-show: 80 %
A deposit already paid will be refunded in full in the event of cancellation free of charge; otherwise, it will be credited against the compensation.
(3) The traveller reserves the right to prove that no damage or substantially less damage has been incurred. No claim to compensation exists if unavoidable and extraordinary circumstances occur at the place of destination or in its immediate vicinity which significantly affect the performance of the tour (§ 651h Abs. 3 BGB).
(4) The traveller may request up to 7 days before the start of the tour that a third party enter into the contract in their place (§ 651e BGB). The traveller and the third party are jointly and severally liable for the tour price and any additional costs incurred.
§ 14 Rebooking
There is no entitlement to a change of travel date, destination or accommodation after conclusion of the contract. If, at the traveller’s request, a rebooking is nevertheless made up to 45 days before the start of the tour, a fee of 50 € per person will be charged. Later rebookings are only possible by cancellation in accordance with § 13 and a new booking.
§ 15 Children
Children (0–2 and 3–12 years) may only participate in private tours and private group tours, not in advertised group tours with fixed dates.
Part C – Groups (Churches and Congregations, Associations, Schools, Organisations)
§ 16 Group Leader and Conclusion of Contract
(1) Group tours are requested through a group leader (e.g. pastor, church leadership, board). The group leader confirms the group offer in text form and names the participants.
(2) The group leader acts as representative of the participants, unless they expressly declare that they are booking in their own name. Each participant receives the standard information form and the travel confirmation via the group leader.
(3) The group offer applies to the stated minimum number of participants. If this number is not reached by the time the list of names is submitted, the price will be adjusted according to the price scale in the offer or the tour may be cancelled in accordance with § 18.
§ 17 Options, List of Names, Payment
(1) Options on hotel allotments are free of charge until the date stated in the offer. Thereafter they lapse without confirmation.
(2) The list of names including room allocation must be submitted no later than 45 days before the start of the tour.
(3) Deposit of 30 % upon receipt of the travel confirmation, balance payment 3 weeks (21 days) before the start of the tour. Payment is made collectively by the group leader or individually by the participants, as agreed in the offer.
(4) Free places for group leaders are only granted if they are expressly stated in the offer.
§ 18 Minimum Number of Participants and Cancellation
If the minimum number of participants stated in the offer is not reached, the Tour Operator may withdraw from the contract no later than 20 days before the start of the tour (tours of more than 6 days) (§ 651h Abs. 4 BGB). Amounts already paid will be refunded without undue delay, at the latest within 14 days.
§ 19 Reduction in Participants and Cancellation by the Group
(1) Closed groups may, if this is agreed in the group offer, withdraw from the contract free of charge up to 93 days before the start of the tour. Up to 60 days before the start of the tour, the number of participants may be reduced by up to 10 % free of charge; the price is then determined according to the price scale for the actual number of participants.
(2) Beyond this, the compensation amounts under § 13 Abs. 2 apply to each cancelling participant and to a cancellation by the entire group. § 13 Abs. 3 and 4 apply accordingly.
§ 20 Programme at the Destination
Church services, devotions, Bible readings and encounters with local congregations are scheduled wherever possible. There is no entitlement to specific churches, service times or encounters unless these have been expressly confirmed. Changes to the order of the programme for organisational reasons are reserved, provided that the overall character of the tour is not impaired.
Part D – Travel Agencies, Agents and Resellers
§ 21 Scope of Application
Part D applies to entrepreneurs within the meaning of § 14 BGB who arrange or resell PASSION tours to third parties (hereinafter “Partners”). Parts B and C do not apply directly to Partners, but only insofar as reference is made to them. Deviating terms of the Partner shall only apply if confirmed in writing by PASSION.
§ 22 Arrangement or Own Organisation by the Partner
(1) Arrangement: If the Partner arranges the tour for travellers in the name of the Tour Operator, Parts A–C apply in relation to the travellers. The Partner is obliged to provide the travellers, prior to conclusion of the contract, with the standard information form, these General Terms and Conditions and the tour description, and to forward the booking data completely and correctly.
(2) Own organisation: If the Partner purchases services in order to offer them in its own name (e.g. as its own package), the Partner is itself the tour operator vis-à-vis its customers and bears all associated obligations, in particular insolvency protection. PASSION and the Tour Operator are then merely service providers vis-à-vis the Partner.
(3) The Partner must state in its request to PASSION which variant applies.
§ 23 Prices, Commission and Payment
(1) Partners receive net prices or a commission in accordance with a separate agreement. In the absence of an agreement, the commission amounts to 10 % of the tour price excluding ancillary costs; it is only earned after full payment and performance of the tour.
(2) Payments must be made in accordance with the invoice: 30 % upon confirmation, balance 3 weeks (21 days) before the start of the tour, without deduction. In the event of default in payment, PASSION is entitled to cancel the services after a reminder; the compensation amounts under § 13 Abs. 2 remain reserved.
(3) The Partner may not demand higher amounts or fees from travellers in the name of PASSION or of the Tour Operator.
§ 24 Allotments, Cancellation, Liability
(1) Allotments and options are valid until the date stated in the confirmation; thereafter unconfirmed places lapse.
(2) For cancellations, the compensation amounts under § 13 Abs. 2 apply, and for groups additionally § 19.
(3) The Partner is liable for damage resulting from incorrect or incomplete information, delayed forwarding and breach of its information obligations towards the travellers, and to that extent indemnifies PASSION and the Tour Operator against claims by third parties.
§ 25 Advertising and Brand
The Partner may use the brand “Reise(n) mit PASSION!”, texts and images only for advertising the booked tours and only in unaltered form. Price information towards end customers must comply with the statutory requirements.
§ 26 Applicable Law and Place of Jurisdiction
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is Magdeburg.
